The Prosecution comes up here and claims that you should feel sorry for poor old Liz Vickers who needs more money from this accident she was in. But you don't realize that Vickers already had her chance to sue Nick Ivy but she settled instead. And now she realizes that she wants some more money from this so she attacks our responsible host. Imagine that you are Mike Hearst right now.

You decided that you wanted to have a perfectly legal gathering at your home. The purpose of this event was never just to get trashed but actually to get to know people. A guest creates a disturbance and is asked to leave. And now you are sitting in this courtroom being charged with causing an accident you were never involved in, facing an $18,000 penalty. This people, is unfair and unlawful when you take a close look at the law. "Every person who negligently serves or causes to be served any alcoholic beverages to an obviously intoxicated person shall be severally liable for injuries to third persons caused by the acts or omissions of the intoxicated person".

That, ladies and gentlemen, is why we are here. You must pay close detail to this law because the fine points of it will declare Mike Hearst's innocence. My client is innocent of these charges for two simple reasons. First, his serving of the alcoholic beverages was not negligent. And secondly, Nick Ivy was not obviously intoxicated at any time Mike Hearst served the alcohol. My client Mike Hearst is a responsible man who has taken much initiative in his life.

He had a group of people over for an evening so he could look for future prospects of his social club. Alcohol happened to be a part of this gathering but everyone at the event was of legal drinking age. This event is 100% and absolutely legal and reasonable. Not once did Hearst force drinks upon anyone and not once was Nick Ivy obviously intoxicated. My client had a legal social gathering and now he is being accused of causing something he had not part of. This is not neglegience here this is being a responsible host and if he is not negligent you must, according to the law, vote not guilty.

At no time whatsoever was Nick Ivy obviously intoxicated on the night of Dec. 15. Ivy is a man who likes to have fun at parties... if this means he will dance on a pool table than so be it. This is not unusual at a party. But what about two men fighting over a video game? I don't know about you but I can remember plenty of times I have been in the same situation. Again, this is not unusual.

We have proven that Nick Ivy had only two beers and one glass of weakly spiked punch in the course of one and a half hours. Now I'm assuming that at least most of you have had experience with alchol before. After three drinks over the coarse of one and a half hours would you be obviously intoxicated, I know I wouldn't be. We must also realize that Nick Ivy is an experienced drinker and could probably handle more alchol than most of you.

Now after this many drinks it is possible that Ivy would be legally drunk but that's not how the law applies itself here. Mike Hearst was only obligated to determine if Nick Ivy was obviously intoxicated. Nick Ivy was never obviously intoxicated and therefore Mike Hearst must be found innocent.
